1. About these Terms
1.1 Who operates the Platform
The Addie Property platform is operated by Proprietas Labs Pty Ltd, ACN 697 946 562 ABN 14697946562, trading as Addie Property.
In these Terms, Addie Property, Addie, we, us and our mean Proprietas Labs Pty Ltd, trading as Addie Property, and where applicable its related bodies corporate, officers, employees, contractors, service providers and authorised representatives.
1.2 What these Terms apply to
These Terms apply to your access to and use of www.addie.house, and any related websites, subdomains, mobile sites, mobile applications, APIs, widgets, data feeds, property search tools, artificial intelligence features, alerts, reports, maps, dashboards, communication tools and other products or services made available by or on behalf of Addie Property.
Together, these are referred to as the Platform.
1.3 Acceptance of these Terms
By accessing, browsing, registering for, using, contributing to or submitting information through the Platform, you agree to be bound by these Terms.
If you use the Platform on behalf of a company, partnership, trust, agency, franchise group, property owner, developer, vendor, landlord, property manager or other organisation, you represent and warrant that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not access or use the Platform.
1.4 Other terms may also apply
These Terms operate together with:
a. our Privacy Policy;
b. our Cookie and Tracking Notice, if applicable;
c. any Listing Content Standards;
d. any Acceptable Use Policy;
e. any Agent, Advertiser or Customer Terms;
f. any API, Data Feed or Integration Terms;
g. any product-specific terms, order forms, insertion orders, subscription terms or schedules; and
h. any additional terms displayed or accepted when you use a specific feature.
If there is an inconsistency between these Terms and product-specific terms, the product-specific terms prevail to the extent of the inconsistency for that product.
1.5 Changes to these Terms
We may update these Terms from time to time.
We may make changes that are administrative, technical, corrective, required by law, required by a regulator, required by a court, necessary for security, necessary to prevent fraud or misuse, or beneficial to users by posting the updated Terms on the Platform or otherwise notifying users.
If a change is likely to materially disadvantage registered users or paid customers, we will take reasonable steps to give advance notice before the change takes effect.
If you are a paid customer and a change materially disadvantages you, you may cancel the affected paid product before the change takes effect, unless the change is required by law, required for security, required to prevent fraud or misuse, or otherwise permitted under applicable product-specific terms.
Changes do not retrospectively alter accrued rights, payment obligations or liabilities unless expressly required by law or agreed by the affected party.
Your continued use of the Platform after an updated version takes effect means you accept the updated Terms.
2. Definitions and interpretation
2.1 Definitions
In these Terms:
Account means a registered account on the Platform.
Advertiser means a person or organisation that submits, publishes, promotes, manages or authorises a Listing, advertisement, profile, campaign, data feed or other property-related content on or through the Platform.
AI Features means any artificial intelligence, machine learning, algorithmic, automated, generative or assisted features made available through the Platform, including search, matching, summaries, recommendations, rankings, chat, alerts, image analysis, property descriptions, suburb insights, estimated values, risk flags and automated responses.
AI Outputs means Content, responses, summaries, classifications, recommendations, estimates, explanations or other outputs generated by or with the assistance of AI Features.
Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Content means text, data, listings, photographs, images, floorplans, videos, maps, graphics, logos, trade marks, audio, comments, reviews, ratings, messages, software, code, APIs, databases, metadata, reports, valuations, estimates, insights, AI Outputs and other material.
Data Product means any data, report, feed, analytics product, API, insight, valuation, market estimate, index, ranking, score, benchmark, lead product or other information product made available by Addie Property.
Enquiry means a message, lead, request, inspection booking, call request, application, expression of interest, saved-property action or other communication submitted through the Platform.
Listing means any advertisement, entry, page or display relating to real property, land, a dwelling, development, commercial premises, rental property, off-market opportunity, project, business, agent, agency, property manager or related service.
Listing Content means Content submitted, supplied, authorised or made available by or on behalf of an Advertiser, agent, agency, vendor, landlord, developer, property manager, owner, contributor, data provider or third-party source in connection with a Listing.
Personal Information has the meaning given in the Privacy Act 1988 (Cth).
Platform has the meaning given in clause 1.2.
Property Information means any information relating to a property, Listing, agent, suburb, school, demographic profile, market, sale, lease, price, rental estimate, value estimate, yield estimate, development, planning matter, zoning matter, risk matter or comparable property.
User Content means Content submitted, uploaded, transmitted, posted, provided or authorised by you or on your behalf.
2.2 Interpretation
In these Terms, unless the context requires otherwise:
a. the singular includes the plural and the plural includes the singular;
b. a reference to a law includes that law as amended, replaced or re-enacted;
c. a reference to a person includes an individual, corporation, partnership, trust, government body and other legal entity;
d. examples are illustrative and do not limit the general wording;
e. headings are for convenience only and do not affect interpretation;
f. a reference to writing includes electronic communications; and
g. where something is subject to our discretion, that discretion must be exercised consistently with applicable law.
3. Platform role
3.1 Addie Property is a technology platform
Addie Property provides a technology platform for property discovery, search, listings, communications, data, alerts, mapping, market information, AI-assisted search and related services.
Unless expressly stated in a separate written agreement, Addie Property is not:
a. a real estate agent;
b. a buyer's agent;
c. a vendor's agent;
d. a property manager;
e. a landlord;
f. a seller;
g. a purchaser;
h. a valuer;
i. a surveyor;
j. a conveyancer;
k. a solicitor;
l. a financial adviser;
m. a mortgage broker;
n. a building inspector;
o. a pest inspector;
p. an insurer; or
q. a party to any sale, lease, agency appointment, management agreement, finance arrangement or other property transaction.
3.2 We do not control property transactions
Addie Property does not control and is not responsible for:
a. whether a property is sold, leased, withdrawn, reserved, unavailable or changed in price;
b. whether a buyer, tenant, agent, vendor, landlord or Advertiser proceeds with a transaction;
c. the terms of any contract, lease, agency appointment, finance arrangement or related transaction document;
d. the physical condition, title, boundaries, zoning, approvals, insurability, value, suitability or legal status of any property; or
e. the conduct of third parties, except to the extent Addie Property is responsible under applicable law for its own conduct.
3.3 Addie Property's own representations
Nothing in these Terms excludes, restricts or modifies any liability Addie Property may have for Addie Property's own false, misleading or deceptive conduct, fraud, wilful misconduct, or any liability that cannot lawfully be excluded, restricted or modified.
3.4 No professional advice
Content on the Platform is general information only unless expressly stated otherwise.
Content is not legal, financial, tax, valuation, investment, building, pest, planning, zoning, engineering, insurance, lending or professional advice.
You should obtain independent advice and verify material information before making any property decision.
4. Eligibility and Accounts
4.1 Eligibility
You must be at least 18 years old to create an Account, submit an Enquiry, submit User Content or use features that require registration.
If you use the Platform on behalf of an organisation, you must be authorised to do so.
4.2 Account registration
When you register for an Account, you must provide accurate, complete and current information.
You must not:
a. create an Account using false, misleading or incomplete information;
b. impersonate another person or organisation;
c. create multiple Accounts to circumvent restrictions, moderation, security controls or usage limits;
d. register an Account on behalf of another person without authority; or
e. use another person's Account without permission.
4.3 Account security
You are responsible for maintaining the confidentiality and security of your login credentials.
You are responsible for all activity that occurs under your Account, except to the extent caused by Addie Property's breach of these Terms, negligence or misconduct.
You must notify us promptly if you suspect unauthorised access to your Account.
4.4 Identity, authority and licence verification
We may require you to verify your identity, authority, licence status, contact details, ownership, agency appointment or other information where reasonably necessary to protect the Platform, users, Advertisers, property owners, tenants, consumers or the integrity of Property Information.
We may decline, suspend or restrict access where verification is not completed, is inaccurate, or raises a reasonable risk of fraud, misuse, illegality, data quality issues or harm.
5. Property Information and Listings
5.1 Sources of Property Information
Property Information on the Platform may come from or be derived from:
a. agents, agencies, landlords, vendors, developers, property managers and other Advertisers;
b. property owners and authorised contributors;
c. public records and government sources;
d. third-party data providers;
e. mapping, geospatial, demographic, school, transport, planning, environmental, hazard, climate, risk and market datasets;
f. user submissions, corrections, enquiries and feedback;
g. automated tools, algorithms and AI Features;
h. historic Listings, sales and leasing activity;
i. publicly available sources; and
j. Addie Property's own analysis, enrichment, ranking and presentation systems.
5.2 Verification status
Unless expressly stated, Addie Property has not independently verified all Property Information.
Property Information may be incomplete, delayed, estimated, inferred, supplied by third parties, generated automatically, affected by market changes or based on assumptions.
5.3 No guarantee of accuracy
To the maximum extent permitted by law, Addie Property does not warrant that Property Information is accurate, complete, current, reliable, suitable, available, verified or free from error.
This clause does not limit Addie Property's liability for its own conduct to the extent that liability cannot lawfully be excluded, restricted or modified.
5.4 Corrections
If you believe Property Information on the Platform is inaccurate, incomplete, stale, misleading, infringing or unlawful, you may notify us using the contact details made available on the Platform.
We may review, correct, label, suppress, remove, archive or leave unchanged Property Information at our reasonable discretion.
5.5 Listing availability
A Listing may remain visible after a property has been sold, leased, withdrawn, reserved, placed under offer, changed in price or otherwise become unavailable.
Addie Property may label, archive, update, remove, suppress or continue to display Listings where reasonably appropriate, including for historical, analytical, compliance, product-improvement or user-information purposes.
5.6 Display order, ranking and recommendations
Search results, property matches, recommendations, rankings, alerts and display order may be influenced by factors including relevance, location, filters, user preferences, recency, data quality, Listing status, paid placement, promotional products, user behaviour, platform performance, fraud prevention and Addie Property's ranking systems.
A higher or lower ranking does not mean that a property is better, more suitable, more valuable, safer, cheaper or more likely to transact.
Where required by law or platform policy, Addie Property may identify paid, sponsored or promoted placements.
6. Property decisions and due diligence
6.1 No blind reliance
You must not rely solely on the Platform, Property Information, AI Outputs, Listings, rankings, recommendations, alerts, estimates or third-party Content when making a property decision.
6.2 Matters to verify
Before buying, selling, renting, leasing, financing, developing, insuring, investing in or otherwise dealing with property, you should independently verify all material matters, including:
a. title and ownership;
b. boundaries and dimensions;
c. easements, covenants, restrictions and encumbrances;
d. zoning, planning controls and development approvals;
e. building approvals, occupation certificates and compliance;
f. strata, community title or body corporate matters;
g. outgoings, levies, rates, land tax and charges;
h. tenancy status, rental income and lease terms;
i. availability, price guide, reserve price and sale method;
j. physical condition, defects and maintenance issues;
k. building, pest, contamination and environmental risks;
l. bushfire, flood, coastal erosion, landslip, mine subsidence, aircraft noise, heritage and other hazard risks;
m. school catchments, transport access and local amenities;
n. NBN, utilities, services and infrastructure;
o. finance, insurance and tax implications;
p. contract terms and special conditions; and
q. any matter that may affect value, use, occupation, development, insurability or suitability.
6.3 Practical steps
You should inspect the property, review the contract and disclosure documents, contact the relevant agent or owner, obtain searches and reports, and obtain independent professional advice where appropriate.
7. AI Features and automated tools
7.1 AI Features
The Platform may include AI Features that assist with property search, natural-language search, Listing summaries, image analysis, recommendations, matching, alerts, suburb insights, market insights, estimated values, estimated rents, ranking, automated responses and other property-related functions.
AI Features are assistive tools. They do not replace independent verification, inspection or professional advice.
7.2 AI Outputs may be inaccurate
AI Outputs may be inaccurate, incomplete, outdated, inconsistent, biased, speculative, unsuitable or misleading.
AI Outputs may:
a. summarise third-party information incorrectly;
b. omit relevant assumptions or qualifications;
c. misinterpret images, floorplans, descriptions or datasets;
d. infer attributes that have not been verified;
e. rely on stale or incomplete data;
f. produce different answers to similar questions; or
g. express uncertainty poorly.
You must verify AI Outputs before relying on them.
7.3 No valuation, legal, finance or investment advice
Unless expressly stated in separate written terms, any value estimate, price estimate, rent estimate, yield estimate, risk indicator, suburb score, ranking, comparable sale selection, investment metric or similar output is indicative information only.
It is not a valuation, appraisal, investment recommendation, financial product advice, credit advice, legal advice, tax advice, insurance advice or prediction of future performance.
7.4 Human review of material public AI content
Where Addie Property uses AI Features to generate or materially modify public-facing Listing Content, Addie Property or the relevant Advertiser should take reasonable steps to review the content before publication.
Advertisers remain responsible for ensuring that Listing Content is accurate, current, not misleading and compliant with law.
7.5 Inputs to AI Features
You must not submit to AI Features any information that:
a. you do not have the right to provide;
b. is confidential to another person without authority;
c. contains Personal Information about another person without consent or other lawful basis;
d. infringes intellectual property rights;
e. is false, misleading, discriminatory, unlawful or harmful; or
f. contains sensitive information unless the relevant feature expressly permits it.
7.6 Use of AI interaction data
Subject to our Privacy Policy and any product-specific terms, Addie Property may use prompts, AI interactions, feedback, metadata and outputs to operate, secure, test, monitor, improve and develop the Platform.
For Personal Information, private Enquiries, rental application data and non-public Account information, our default position is:
a. we use it to provide, secure, support and improve the Platform;
b. we may use aggregated or de-identified data for analytics and product development; and
c. we do not permit third-party foundation model providers to use non-public Personal Information from Addie Property for their independent model training unless this is disclosed in our Privacy Policy, permitted by law, authorised by the relevant user, or governed by separate written terms.
7.7 Automated decisions
If Addie Property uses computer programs or AI Features to make, or substantially assist in making, decisions that could reasonably be expected to significantly affect a person's rights or interests and Personal Information is used in that process, Addie Property will describe the relevant practices in its Privacy Policy where required by law.
7.8 Similar outputs
AI Features may generate the same or similar outputs for different users.
You do not obtain exclusive rights in AI Outputs.
8. Enquiries, leads and communications
8.1 Submitting Enquiries
You may be able to submit Enquiries through the Platform to agents, agencies, property managers, developers, landlords, vendors, service providers or other Advertisers.
When you submit an Enquiry, you authorise Addie Property to send the Enquiry and related information to the relevant recipient.
8.2 Accuracy of Enquiries
You must ensure that any Enquiry you submit is genuine, accurate and not misleading.
You must not submit Enquiries that are:
a. false, fraudulent or deceptive;
b. abusive, harassing, threatening or discriminatory;
c. spam, automated or bulk-generated;
d. submitted for data-harvesting, market research, competitive intelligence or scraping;
e. submitted to test, burden or manipulate the Platform; or
f. unrelated to a genuine property, service or transaction interest.
8.3 Addie Property may filter Enquiries
We may review, filter, delay, block, suppress, refuse to deliver or remove Enquiries where we reasonably consider this necessary to protect users, Advertisers, the Platform, privacy, security, data quality or legal compliance.
We are not required to deliver any Enquiry that we reasonably suspect is fraudulent, abusive, automated, unlawful, misleading or contrary to these Terms.
8.4 Advertiser use of Enquiries
Advertisers who receive Enquiries through the Platform must use the Personal Information in those Enquiries only to respond to the relevant Enquiry, property, service or transaction, unless the individual has given separate consent or another lawful basis applies.
Advertisers must not sell, rent, trade, scrape, enrich, pool, transfer, misuse or send unrelated marketing using Enquiry data except as permitted by law, these Terms and any applicable Advertiser Terms.
8.5 Communications with third parties
If you communicate with an Advertiser or other third party through or because of the Platform, that communication is between you and the third party.
Addie Property is not responsible for the content, legality, accuracy, timing, conduct, outcome or consequences of those communications, except to the extent required by law.
9. User Content
9.1 User Content you submit
You may be able to submit User Content, including Enquiries, comments, corrections, reviews, ratings, saved preferences, property notes, photographs, documents, Listing Content, feedback or other material.
You are responsible for your User Content.
9.2 Standards for User Content
You must ensure that your User Content:
a. is true, accurate, current and not misleading;
b. is not unlawful, fraudulent, defamatory, obscene, threatening, abusive, harassing, discriminatory or offensive;
c. does not infringe any intellectual property, privacy, confidentiality, moral, publicity or contractual rights;
d. does not contain viruses, malware, tracking code, spyware or harmful code;
e. does not contain Personal Information about another person unless you have consent or another lawful basis;
f. does not misrepresent your identity, authority, affiliation or relationship with any person;
g. does not manipulate rankings, reviews, ratings, search results, engagement, leads or platform metrics;
h. does not promote illegal conduct; and
i. complies with these Terms and any applicable policy.
9.3 Reviews and ratings
If the Platform allows reviews, ratings or testimonials, you must ensure they are genuine, based on your own experience, not misleading and not submitted in exchange for undisclosed benefits.
You must not submit or procure fake reviews, paid reviews, competitor attacks, self-reviews, review gating, manipulated ratings or reviews submitted by employees, agents, affiliates or related parties without clear disclosure.
9.4 Moderation and removal
We may, but are not required to, review, moderate, edit, reject, remove, restrict, label, suspend or disable access to User Content where we reasonably consider that it:
a. breaches these Terms;
b. may breach law;
c. may expose Addie Property or another person to liability;
d. may be inaccurate, misleading or harmful;
e. may infringe third-party rights;
f. may compromise platform integrity, privacy or security; or
g. is otherwise inappropriate for the Platform.
Moderation does not mean that Addie Property has verified or approved the User Content.
10. Licence you grant to Addie Property
10.1 Ownership
You retain ownership of rights you hold in your User Content.
10.2 Public User Content licence
For User Content that you submit for public display, publication, review, correction, feedback, forum, comment, rating, Listing contribution or similar public purposes, you grant Addie Property a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence to use, host, store, reproduce, copy, modify, adapt, edit, crop, resize, translate, communicate, publish, display, distribute, index, analyse, process and create derivative works from that User Content for the purposes of operating, providing, improving, promoting and protecting the Platform.
10.3 Listing Content licence
If you submit, authorise, manage or supply Listing Content, you grant Addie Property a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence to:
a. host, store, display, publish and communicate the Listing Content;
b. crop, resize, reformat, edit, tag, classify, translate and adapt the Listing Content for Platform presentation;
c. use the Listing Content in search, maps, alerts, recommendations, analytics, reports and Data Products;
d. promote the Listing, Advertiser and Platform;
e. syndicate or distribute the Listing Content where permitted;
f. archive historical Listing Content, including sold, leased, withdrawn and expired Listings;
g. use Listing Content for data quality, fraud prevention, compliance, product improvement and market analytics; and
h. use aggregated or de-identified Listing data for Platform improvement, insights and Data Products.
10.4 Private content and Enquiries
For private messages, Enquiries, saved notes, Account data, rental application material and other non-public User Content, you grant Addie Property a licence only to the extent reasonably necessary to:
a. provide, operate, secure and support the relevant feature;
b. send or process the relevant Enquiry;
c. comply with law;
d. detect and prevent fraud, spam, scraping, misuse or security incidents;
e. maintain business records;
f. resolve disputes; and
g. improve the Platform in accordance with our Privacy Policy.
10.5 Duration
The licences in clauses 10.2 and 10.3 continue after deletion, delisting, withdrawal, Account closure or termination to the extent the content has been:
a. published or displayed publicly;
b. incorporated into historical property records;
c. used in analytics, reports or Data Products;
d. used for fraud prevention, security, audit or compliance;
e. retained in backups;
f. required for legal or dispute purposes; or
g. otherwise reasonably retained for legitimate business purposes.
For private content, the licence continues only for the purposes in clause 10.4 and subject to our Privacy Policy.
10.6 Moral rights
To the extent permitted by law, you consent to Addie Property and its licensees doing acts in relation to your User Content that are reasonably necessary for technical, editorial, presentation, publication, accessibility, security, archiving or platform-operation purposes and that may otherwise infringe your moral rights.
This includes cropping, resizing, formatting, correcting typographical errors, combining with other content, not attributing content in every context, and adapting content for different devices, channels or layouts.
10.7 Warranties
You represent and warrant that:
a. you own or have sufficient rights to submit and license the User Content;
b. the User Content complies with these Terms;
c. Addie Property's use of the User Content in accordance with these Terms will not infringe third-party rights; and
d. all required consents, permissions, licences and authorisations have been obtained.
11. Listing contributors and Advertisers
11.1 Application
This section applies if you submit, approve, upload, syndicate, manage, promote, correct or authorise Listing Content, whether as an agent, agency, property manager, developer, vendor, landlord, owner, employee, contractor, data provider, feed provider or other contributor.
Additional Agent, Advertiser, API, Data Feed or Customer Terms may also apply.
11.2 Authority
You must not submit or authorise Listing Content unless you have all necessary authority to do so.
You represent and warrant that:
a. you are authorised by the relevant owner, vendor, landlord, developer, agency, property manager or principal;
b. you hold all licences, registrations, approvals and permissions required to perform your role;
c. you have authority to use and license all Listing Content;
d. you have obtained all privacy consents required for Personal Information included in or connected with the Listing Content;
e. publication will not breach law, contract, fiduciary duty, professional obligation or third-party rights; and
f. you will maintain records reasonably necessary to substantiate Listing Content and price representations.
11.3 Listing accuracy
You must ensure that Listing Content is accurate, complete, current, not misleading and compliant with law.
This includes, where relevant:
a. address and location information;
b. property type and tenure;
c. land size, floor area and dimensions;
d. bedrooms, bathrooms, car spaces and other features;
e. price guide, sale method, rent, outgoings, incentives and charges;
f. inspection times and auction details;
g. availability and status;
h. known material limitations, restrictions or conditions;
i. agency, Advertiser and contact details;
j. image, floorplan, video, render and virtual-tour accuracy; and
k. required statutory disclosures.
11.4 Sale price advertising and underquoting
Advertisers are responsible for ensuring all sale price statements, price guides, auction guides, comparable sales, market estimates and related representations comply with applicable law.
You must not submit Listing Content that:
a. states or suggests a price below the reasonable estimated selling price where this would be unlawful or misleading;
b. uses prohibited, misleading or ambiguous price terminology;
c. advertises below an offer or bid that can no longer lawfully be undercut in advertising;
d. omits a price guide, statement of information or other disclosure required by law;
e. uses comparable sales or suburb data in a misleading way;
f. represents a price estimate without reasonable grounds;
g. fails to update price information promptly; or
h. otherwise misleads users about price, value, demand, likely sale price or transaction terms.
11.5 Rental advertising
For residential rental Listings in New South Wales, and in any other jurisdiction with equivalent requirements, Advertisers must ensure that:
a. the advertisement states a fixed rent amount where required;
b. the Listing is not advertised using a range, "offers from", "by negotiation", "make an offer", "submit your best offer" or similar language where prohibited;
c. the Listing does not solicit or invite a tenant to offer more than the advertised rent;
d. any application flow does not encourage or require rent bidding;
e. the Listing does not state that pets are not allowed where such wording is prohibited; and
f. status wording such as "deposit taken", "under application" or "leased" is accurate and not misleading.
11.6 Images, renders, AI imagery and virtual staging
Listing images, videos, renders, floorplans, virtual tours and visual material must not mislead users.
Without limitation:
a. digitally altered images must not conceal defects, damage, mould, water ingress, undesirable infrastructure, outlook limitations or material features;
b. virtual staging must not misrepresent room size, fit, layout, inclusions or condition;
c. artist impressions, renders, computer-generated images and AI-generated images must be labelled where necessary to avoid misleading users;
d. floorplans must not materially misstate dimensions, orientation, layout or inclusions;
e. images should not imply that fixtures, fittings, views, furniture or finishes are included if they are not; and
f. historic, seasonal or enhanced imagery must be used carefully and labelled where necessary.
11.7 Prompt correction
You must promptly update, correct, withdraw or notify Addie Property of any Listing Content that becomes inaccurate, incomplete, misleading, unlawful, stale or no longer authorised.
This includes where a property is sold, leased, withdrawn, under offer, under application, unavailable, repriced, changed in campaign method, materially changed in description, or affected by new information.
11.8 Addie Property moderation
We may review, reject, edit, crop, resize, reformat, classify, rank, label, suppress, archive, remove or refuse to publish Listing Content where we reasonably consider this necessary to:
a. comply with law;
b. protect users;
c. maintain data quality;
d. avoid misleading conduct;
e. manage Platform performance;
f. protect privacy, security or intellectual property;
g. prevent fraud, scraping or misuse;
h. enforce these Terms; or
i. maintain Platform integrity.
11.9 Historical Listing use
Unless otherwise agreed in writing, Addie Property may retain, use, display, analyse and commercialise Listing Content and related data after a property is sold, leased, withdrawn, expired or removed for historical property records, market insights, analytics, compliance, fraud prevention, product improvement, property matching and Data Products.
12. Addie Property intellectual property
12.1 Ownership
Addie Property and its licensors own all rights, title and interest in the Platform and Addie Property Content, including software, interfaces, designs, databases, compilations, algorithms, AI Features, models, prompts, workflows, ranking systems, reports, analytics, Data Products, branding and trade marks.
Except as expressly permitted by these Terms, you do not acquire any rights in the Platform or Addie Property Content.
12.2 Limited user licence
Subject to these Terms, Addie Property grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for your own lawful personal or internal business purposes.
This licence does not allow you to:
a. copy, reproduce, publish, republish, frame, mirror, adapt, modify, sell, license, distribute or commercially exploit the Platform or Addie Property Content;
b. reverse engineer, decompile, disassemble or attempt to derive source code or underlying models;
c. access the Platform to build or improve a competing product or service;
d. use Platform data for unauthorised AI, machine learning, modelling or data products; or
e. use Addie Property trade marks without written permission.
12.3 Feedback
If you provide feedback, suggestions, ideas, bug reports, feature requests or other comments about the Platform, Addie Property may use them without restriction or obligation to compensate you.
13. Prohibited conduct
You must not:
a. use the Platform unlawfully or in breach of these Terms;
b. provide false, misleading, deceptive or incomplete information;
c. impersonate another person or organisation;
d. interfere with, disrupt, overload or degrade the Platform;
e. bypass, disable or circumvent security, access, authentication, rate-limiting, robots.txt, CAPTCHA, anti-scraping or technical controls;
f. introduce viruses, malware, spyware, ransomware, worms, logic bombs or other harmful code;
g. attempt to gain unauthorised access to Accounts, systems, data, APIs, infrastructure or networks;
h. harvest, collect or misuse Personal Information;
i. submit spam, fake Enquiries, fake reviews or automated messages;
j. manipulate rankings, search results, metrics, reviews, leads, traffic or engagement;
k. use the Platform to harass, abuse, threaten, discriminate against or harm another person;
l. submit or distribute unlawful, infringing, defamatory, obscene, abusive or discriminatory material;
m. misrepresent property availability, price, status, authority or transaction terms;
n. conduct vulnerability testing, penetration testing or load testing without written permission;
o. use the Platform for surveillance, profiling or unlawful discrimination; or
p. assist another person to do any of the above.
14. No scraping, data mining or competitive use
14.1 Automated access prohibited
You must not use bots, crawlers, spiders, scrapers, harvesters, data-mining tools, browser extensions, automated scripts, agents, macros or other automated means to access, query, copy, monitor, index, extract, download, cache or store any part of the Platform or Content without Addie Property's written permission.
14.2 Bulk extraction prohibited
You must not, without Addie Property's written permission:
a. bulk download, copy, store, export or compile Listings or Property Information;
b. create or maintain a property database using Platform data;
c. monitor Platform Content at scale;
d. systematically collect prices, addresses, property attributes, images, floorplans, agent details or lead information;
e. extract Content for market research, valuation, investment, lending, insurance, development, prospecting or competitive intelligence at scale;
f. use manual processes to replicate automated scraping or bulk extraction; or
g. encourage or assist another person to do so.
14.3 Competitive products prohibited
You must not use the Platform, Addie Property Content, Listing Content or Property Information to create, train, test, validate, benchmark, enrich, operate or improve:
a. a competing property portal;
b. a searchable property database;
c. an automated valuation model;
d. a price-estimation product;
e. a rental-estimation product;
f. a property insights product;
g. a lead-generation database;
h. an agent-ranking or agency-ranking product;
i. a market-research product;
j. a browser extension, plug-in or overlay;
k. an AI assistant, chatbot, agent or search product;
l. a machine-learning model; or
m. any other commercial data product,
unless Addie Property has given written permission.
14.4 AI training and model use
You must not use Platform Content, Addie Property Content, Listing Content, Property Information, Data Products or Enquiry data to train, fine-tune, ground, test, benchmark, evaluate or improve any AI, machine-learning, large language model, computer vision model, search model, recommendation model or automated decision system without Addie Property's written permission.
14.5 Framing, mirroring and republication
You must not frame, mirror, embed, hotlink, republish, syndicate, display or distribute any part of the Platform or Content on another website, app, product or service without Addie Property's written permission.
15. APIs, data feeds and integrations
15.1 Written permission required
You may access Addie Property APIs, data feeds, integrations, bulk data, webhooks, partner tools or developer features only if Addie Property has authorised you to do so under separate written terms.
15.2 API restrictions
If you are authorised to use an API, data feed or integration, you must comply with all applicable technical documentation, authentication requirements, rate limits, usage restrictions, data-handling requirements and product-specific terms.
You must not use API access to circumvent these Terms or obtain data that you would otherwise be prohibited from accessing or using.
15.3 Suspension of API access
We may suspend, throttle, restrict or revoke API, feed or integration access where reasonably necessary to protect security, performance, privacy, data quality, legal compliance or Platform integrity.
16. Third-party Content, links and services
16.1 Third-party Content
The Platform may contain third-party Content, links, advertisements, maps, data, widgets, embedded tools, referral offers, partner services or integrations.
Addie Property does not necessarily endorse, verify or control third-party Content or services.
16.2 Third-party terms
Your use of third-party services may be subject to separate terms, privacy policies, fees and conditions imposed by the relevant third party.
You are responsible for reviewing those terms.
16.3 Referral and partner offers
Addie Property may receive fees, commissions, referral payments, advertising revenue or other benefits from third parties, including agents, mortgage brokers, lenders, insurers, conveyancers, removalists, utilities providers, inspection providers, developers or other partners.
Where required by law or Platform policy, Addie Property will disclose sponsored, promoted, paid or referral-based relationships.
16.4 Maps and location data
Maps, geospatial tools, boundaries, commute times, school zones, overlays, risk layers and location data are indicative only and may be inaccurate, incomplete or outdated.
You must independently verify any location-based information that is material to your decision.
17. Privacy, personal information and marketing
17.1 Privacy Policy
We handle Personal Information in accordance with our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, hold, secure and otherwise handle Personal Information, including information collected through Accounts, Enquiries, alerts, saved searches, cookies, analytics, AI Features, rental application features, Advertiser tools and third-party integrations.
17.2 Privacy by design
Addie Property intends to take reasonable steps to limit Personal Information collection to what is reasonably necessary for the relevant purpose.
Where practical, Addie Property may allow users to browse, search or use selected features without identifying themselves.
17.3 Information about others
If you provide Personal Information about another person, you represent and warrant that:
a. you have the authority, consent or other lawful basis required to provide it;
b. the person has been informed of the matters required by applicable privacy laws; and
c. Addie Property may handle the information in accordance with our Privacy Policy.
17.4 Enquiry sharing
When you submit an Enquiry, we may share your name, contact details, message, property interest, Account information and related details with the relevant Advertiser or recipient so they can respond.
Submitting an Enquiry does not, by itself, consent to unrelated marketing by the recipient.
17.5 Rental application information
If Addie Property offers rental application tools, tenant screening tools, inspection registration tools or similar features, additional terms and privacy notices may apply.
Advertisers and property managers must not use Addie Property to collect more Personal Information from prospective tenants than is reasonably necessary for the relevant rental process.
Unless expressly permitted by the relevant feature and law, Advertisers must not require prospective tenants to provide social media account access, unnecessary identity documents, excessive financial information, protected attributes, or other information unrelated to assessing the rental application.
17.6 Direct marketing
We will send commercial electronic marketing messages only where permitted by law.
Marketing consent must be clear as to purpose, channel, sender or class of sender, duration and withdrawal method.
We will include required sender details and unsubscribe functionality in commercial electronic messages where required.
17.7 Advertiser use of Personal Information
Advertisers receiving Personal Information through the Platform must:
a. use it only for the purpose for which it was provided, unless another lawful basis applies;
b. comply with privacy, spam, consumer and tenancy laws;
c. keep it secure;
d. not sell, trade, rent, pool, enrich or misuse it;
e. not use it for unrelated marketing without consent;
f. honour unsubscribe and opt-out requests; and
g. delete or de-identify it when no longer reasonably required, subject to lawful record-keeping obligations.
17.8 Overseas providers and processors
We may use cloud, analytics, communications, mapping, AI, security, support and other service providers located in Australia or overseas.
Our Privacy Policy will describe likely overseas disclosures where required by law.
17.9 Automated decisions
Where required by law, our Privacy Policy will describe the use of computer programs or AI systems that use Personal Information to make, or substantially assist in making, decisions that could reasonably be expected to significantly affect rights or interests.
17.10 Cookies and tracking
We may use cookies, pixels, tags, device identifiers, analytics tools, advertising technologies and similar technologies to operate, secure, personalise, measure and improve the Platform, subject to our Privacy Policy and Cookie and Tracking Notice.
18. Security and Platform integrity
18.1 Security measures
We use technical and organisational measures that we consider appropriate to protect the Platform.
However, no online service is completely secure, uninterrupted or error-free.
18.2 Security reporting
If you identify a security vulnerability, you must report it to us promptly at [insert security email].
You must not exploit, disclose, retain, exfiltrate, destroy, modify or misuse data or systems.
18.3 Platform monitoring
We may monitor Platform activity to detect fraud, misuse, scraping, automated access, security threats, policy breaches, unlawful conduct, data quality issues and operational problems.
19. Availability and changes to the Platform
19.1 Availability
We aim to make the Platform available, but we do not guarantee uninterrupted, continuous, secure or error-free access.
The Platform may be affected by outages, maintenance, technical issues, cyber incidents, third-party failures, network issues, data provider issues, legal requirements or events outside our control.
19.2 Changes to features
We may modify, improve, replace, suspend, discontinue or remove any Platform feature, product, Content, Listing category, AI Feature, data source or service.
For paid products, any rights to refunds, credits or termination will be governed by the relevant product-specific terms.
19.3 Beta and experimental features
Some features may be labelled or treated as beta, pilot, preview, experimental or early-access features.
Those features may be less reliable, less accurate, changed without notice, discontinued, limited to selected users or subject to additional terms.
20. Suspension and termination
20.1 Suspension or restriction by Addie Property
We may suspend, restrict, throttle, disable or terminate your access, remove Content, disable an Account, block an IP address, limit usage, withhold Enquiries or take other reasonable action if we reasonably consider that:
a. you have breached these Terms;
b. your conduct may breach law;
c. your Account is compromised or used without authority;
d. your activity creates security, privacy, legal, reputational, operational or technical risk;
e. your activity involves scraping, automated access, fake Enquiries, fake reviews, spam, fraud or misuse;
f. you provided false, misleading or incomplete information;
g. you failed identity, authority, licence or ownership verification;
h. we are required or requested to act by law, regulator, court, law enforcement or rights holder; or
i. continued access may harm Addie Property, users, Advertisers, third parties or the Platform.
20.2 Notice and opportunity to respond
Where reasonable, lawful and practicable, we will provide notice of material suspension or termination and an opportunity to respond.
We may act without prior notice where necessary for security, fraud prevention, legal compliance, user protection, evidence preservation, urgent operational integrity or prevention of harm.
20.3 Review
If you believe we have suspended, restricted or terminated your access in error, you may contact us using the process made available on the Platform.
We will review the issue within a reasonable time.
20.4 Termination by you
You may stop using the Platform at any time.
Registered users may request Account closure using the process made available by Addie Property.
Account closure does not affect rights, obligations or licences that have accrued or that are intended to survive termination.
20.5 Consequences of termination
On termination or Account closure:
a. your right to access restricted parts of the Platform ends;
b. we may delete, de-identify, retain or archive your Account information and User Content in accordance with our Privacy Policy, legal obligations and legitimate business purposes;
c. licences granted to Addie Property continue to the extent set out in these Terms;
d. you remain responsible for breaches occurring before termination; and
e. clauses intended to survive termination continue.
21. Consumer rights and non-excludable obligations
21.1 Non-excludable rights preserved
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory guarantee, warranty, right, remedy, liability or protection under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
21.2 Limitation where permitted
Where liability for breach of a non-excludable guarantee can lawfully be limited, Addie Property's liability is limited, at Addie Property's option, to:
a. resupplying the relevant services; or
b. paying the cost of resupplying the relevant services.
22. Disclaimers
Subject to clause 21 and to the maximum extent permitted by law:
a. the Platform and Content are provided on an "as is" and "as available" basis;
b. Addie Property does not warrant that the Platform or Content will be uninterrupted, error-free, secure or free from harmful code;
c. Addie Property does not verify all Listing Content, Property Information, Advertisers, users, data sources or third-party services;
d. Addie Property does not warrant that any property, Listing, Advertiser, Enquiry, AI Output, estimate, insight, ranking or recommendation will meet your requirements;
e. Addie Property does not warrant that any property transaction, Enquiry, inspection, application, offer, lease or sale will proceed or complete; and
f. you use the Platform and Content at your own risk.
Nothing in this clause limits Addie Property's liability for Addie Property's own false, misleading or deceptive conduct, fraud, wilful misconduct or any liability that cannot lawfully be limited.
23. Liability
23.1 Excluded losses
Subject to clause 21 and to the maximum extent permitted by law, Addie Property is not liable for:
a. indirect, consequential, special, exemplary or punitive loss;
b. loss of profit, revenue, income, business, opportunity, goodwill, reputation, anticipated savings or data;
c. loss arising from property decisions, market movements, failed transactions, finance issues, valuation changes, rental outcomes or investment performance;
d. loss arising from inaccurate, incomplete, outdated or misleading Listing Content or Property Information supplied by third parties;
e. loss arising from third-party conduct, communications, services, links or Content;
f. loss arising from AI Outputs or automated recommendations, except to the extent Addie Property is responsible under applicable law;
g. loss arising from unauthorised Account use, except to the extent caused by Addie Property's breach, negligence or misconduct; or
h. loss arising from outages, interruptions, errors, viruses, cyber incidents or data provider failures, except to the extent caused by Addie Property's breach, negligence or misconduct.
23.2 Liability cap
Subject to clauses 21 and 23.3 and to the maximum extent permitted by law, Addie Property's total liability to you arising out of or in connection with these Terms or the Platform is limited to:
a. for users who have not paid fees to Addie Property in the previous 12 months: AUD $5,000; and
b. for users who have paid fees to Addie Property in the previous 12 months: the greater of AUD $5,000 and the fees paid by you to Addie Property for the relevant product or service in the 12 months before the event giving rise to liability.
23.3 Carve-outs
The liability cap does not apply to liability that cannot lawfully be limited, including liability arising from:
a. fraud;
b. wilful misconduct;
c. death or personal injury caused by negligence, where applicable;
d. Addie Property's own misleading or deceptive conduct to the extent it cannot be limited;
e. breach of non-excludable consumer guarantees to the extent it cannot be limited; or
f. any other liability that cannot lawfully be excluded, restricted or capped.
23.4 Liability reduction
Addie Property's liability is reduced to the extent the loss was caused or contributed to by:
a. your acts or omissions;
b. your breach of these Terms;
c. third-party conduct;
d. inaccurate or incomplete information supplied by you or a third party;
e. your failure to verify information or obtain appropriate advice; or
f. events outside Addie Property's reasonable control.
24. Indemnity
You indemnify Addie Property against losses, liabilities, damages, costs and expenses reasonably incurred by Addie Property arising from or in connection with:
a. your breach of these Terms;
b. your User Content or Listing Content;
c. your unlawful, fraudulent, negligent, reckless or wilful conduct;
d. your infringement of third-party rights;
e. your misuse of Enquiry data or Personal Information;
f. your scraping, automated access, data extraction or unauthorised data use;
g. your breach of privacy, spam, consumer, property, advertising or intellectual property laws; or
h. any third-party claim arising from your conduct.
This indemnity is reduced to the extent the relevant loss is caused or contributed to by Addie Property's breach of these Terms, negligence, fraud, wilful misconduct or unlawful conduct.
For consumer users, this indemnity applies only to the extent it is fair, reasonable and permitted by law.
25. Intellectual property complaints
25.1 Reporting infringement
If you believe Content on the Platform infringes your intellectual property rights, you may notify us at [insert IP email] with:
a. your name and contact details;
b. identification of the protected work;
c. identification of the allegedly infringing Content;
d. a statement explaining your rights and the alleged infringement;
e. any relevant supporting material; and
f. a declaration that the information you provide is accurate.
25.2 Our response
We may remove, disable, restrict or restore Content in response to intellectual property complaints, counter-notices, legal risk or other relevant information.
We are not required to adjudicate disputes between users, Advertisers and rights holders.
26. Confidentiality
If you receive non-public information from Addie Property, including technical information, commercial information, pricing, product plans, security information, API documentation, data specifications or beta-feature information, you must keep it confidential and use it only for the purpose for which it was provided.
This clause does not apply to information that is public other than through your breach, independently developed, lawfully received from a third party, or required to be disclosed by law.
27. Compliance with laws
You must comply with all laws applicable to your access to and use of the Platform, including laws relating to:
a. consumer protection;
b. misleading or deceptive conduct;
c. real estate advertising;
d. underquoting;
e. rent bidding and rental advertising;
f. property licensing;
g. privacy;
h. spam and electronic marketing;
i. intellectual property;
j. defamation;
k. anti-discrimination;
l. cybersecurity;
m. confidential information;
n. sanctions and export controls; and
o. competition.
You are responsible for determining which laws apply to you and your use of the Platform.
28. Assignment and subcontracting
You must not assign, transfer or novate your rights or obligations under these Terms without Addie Property's written consent.
Addie Property may assign, transfer, novate or subcontract its rights and obligations under these Terms as part of a merger, acquisition, restructure, sale of business, sale of assets, financing arrangement or transfer to a related body corporate, provided this does not materially reduce your rights under these Terms.
29. Force majeure
Addie Property is not liable for delay or failure to perform obligations caused by events outside its reasonable control, including natural disasters, fire, flood, storm, war, terrorism, civil unrest, labour disputes, pandemics, government action, law changes, utility failures, telecommunications failures, cloud provider failures, cyberattacks, data provider failures or other events beyond reasonable control.

31. Complaints and disputes
31.1 Contact us first
If you have a complaint or dispute about the Platform, you may contact us using the details in clause 30.
We will take reasonable steps to review and respond to complaints within a reasonable time.
31.2 Urgent relief
Nothing in this clause prevents either party from seeking urgent injunctive, equitable or protective relief.
31.3 Consumer rights unaffected
Nothing in this clause limits any rights you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
32. Severability
If any provision of these Terms is invalid, unlawful or unenforceable, that provision is severed or read down to the minimum extent necessary, and the remaining provisions continue in force.
33. Waiver
A failure or delay by Addie Property to exercise a right under these Terms does not waive that right.
A waiver is effective only if in writing and only for the specific instance for which it is given.
34. Entire agreement
These Terms, together with any applicable policies, product-specific terms and order forms, constitute the agreement between you and Addie Property regarding your use of the Platform.
They supersede prior understandings about that subject matter.
35. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
Nothing in this clause prevents Addie Property from seeking urgent injunctive, equitable or protective relief in any jurisdiction where necessary to protect its rights, users, data, systems or Platform.
36. Survival
Clauses that by their nature should survive termination continue after termination, including clauses relating to intellectual property, licences, privacy, data use, anti-scraping, confidentiality, disclaimers, liability, indemnities, governing law, dispute resolution and accrued rights.
Schedule 1 - Acceptable Use Policy
This Acceptable Use Policy forms part of the Terms.
You must not use the Platform to:
1. breach any law or regulation;
2. mislead or deceive any person;
3. submit false, stale, incomplete or misleading Property Information;
4. advertise property without authority;
5. engage in underquoting or misleading price advertising;
6. breach rental advertising, rent bidding or tenant data laws;
7. submit fake, fraudulent, abusive or automated Enquiries;
8. scrape, crawl, index, mine, copy or extract Platform data;
9. build or improve a competing product using Platform data;
10. use Platform data for unauthorised AI training or model development;
11. harvest Personal Information;
12. send spam or unsolicited commercial electronic messages;
13. submit fake reviews or manipulate ratings;
14. interfere with Platform operation, ranking, security or integrity;
15. reverse engineer the Platform;
16. bypass access controls or rate limits;
17. upload malware or harmful code;
18. infringe intellectual property rights;
19. publish defamatory, discriminatory, abusive or unlawful material;
20. stalk, harass, threaten or harm another person;
21. impersonate another person or organisation;
22. conceal or misrepresent your identity, authority or affiliation;
23. use the Platform for surveillance or unlawful profiling;
24. misuse Enquiry data; or
25. assist another person to do any prohibited act.
Addie Property may investigate suspected breaches and take action under the Terms.
Schedule 2 - Listing Content Standards
This Schedule applies to all Listing Content submitted to the Platform.
1. Authority
You must have authority to submit, publish and license the Listing Content.
2. Accuracy
Listing Content must be accurate, complete, current and not misleading.
You must be able to substantiate material claims.
3. Sale price and underquoting
Sale Listings must comply with applicable underquoting, price guide, auction, comparable-sales, vendor-instruction and disclosure laws.
You must not:
a. advertise below a reasonable estimated selling price where unlawful or misleading;
b. advertise below a rejected offer or bid where unlawful or misleading;
c. use misleading expressions such as "offers over", "from", "plus", "starting at" or equivalent expressions where prohibited or misleading;
d. omit required price guides, statements of information or equivalent disclosures;
e. use stale or cherry-picked comparable sales;
f. fail to revise price information when required; or
g. create an overall misleading impression about price, demand or likely sale outcome.
4. Rental price and rent bidding
Rental Listings must comply with fixed-rent, rent-bidding and rental advertising laws.
For New South Wales residential rental Listings, you must not:
a. advertise a rent range;
b. use "offers from", "by negotiation", "make an offer" or similar wording;
c. solicit or invite a rent offer above the advertised rent;
d. design the application process to encourage rent bidding; or
e. use "no pets" wording or equivalent prohibited pet-exclusion advertising.
5. Property attributes
Bedrooms, bathrooms, car spaces, land size, floor area, zoning, property type, views, renovation status, approvals, fixtures, inclusions, outgoings, strata levies and other attributes must not be overstated or misleading.
6. Images, renders and floorplans
Photos, videos, renders, floorplans, virtual staging and virtual tours must not materially misrepresent the property.
You must clearly label or disclose, where necessary:
a. artist impressions;
b. renders;
c. virtual staging;
d. AI-generated imagery;
e. digitally altered imagery;
f. historic imagery;
g. proposed finishes or inclusions;
h. non-standard lens effects; and
i. images that show items, views, fixtures or conditions not included or not currently present.
7. Defects and visual concealment
You must not use image editing, AI, staging, camera angles, cropping, lighting, overlays or other techniques to conceal material defects, mould, water damage, structural issues, undesirable infrastructure, outlook limitations, neighbouring structures, safety issues or other material matters.
8. Availability and status
You must promptly update the Listing if the property is sold, leased, withdrawn, unavailable, under offer, under application, repriced, changed in campaign method or materially changed.
9. Legal rights
You must have rights to use all photographs, floorplans, videos, copy, branding, reports and other Content included in the Listing.
10. Privacy
Listing Content must not include Personal Information, images of people, tenant information, owner information, security details or private information unless you have authority or consent and inclusion is lawful and appropriate.
11. Prohibited Listing Content
Listing Content must not:
a. be false, misleading or deceptive;
b. be unlawful or discriminatory;
c. infringe third-party rights;
d. include malware, tracking pixels or unauthorised data collection tools;
e. promote illegal conduct;
f. contain offensive, abusive or defamatory material;
g. misrepresent agency authority;
h. misrepresent price, availability, condition or suitability;
i. mislead users about schools, catchments, transport, planning, hazards, risks or approvals; or
j. breach Addie Property policies.
Schedule 3 - AI and Automated Property Information Terms
1. AI is assistive
AI Features assist with search, discovery, summarisation, comparison, ranking, recommendations and information retrieval. They do not make property decisions for you.
2. Verification required
You must verify AI Outputs before relying on them.
3. No professional advice
AI Outputs are not legal, financial, tax, valuation, investment, building, pest, planning, zoning, insurance, credit or real estate advice.
4. No sole reliance
You must not rely solely on AI Outputs to buy, sell, rent, lease, finance, insure, develop or invest in property.
5. Estimates are indicative
Price, value, rent, yield, growth, risk, suburb and comparable-property outputs are indicative only and may be based on incomplete, historic, inferred, third-party or automated data.
6. User responsibility for prompts
You are responsible for prompts, files, data and other information you submit to AI Features.
7. Restricted inputs
You must not submit confidential, personal, sensitive, unlawful or third-party information unless you have authority and the relevant feature permits it.
8. No public AI Listing Content without review
Advertisers must not publish AI-generated Listing Content without checking that it is accurate, current, not misleading and compliant with law.
9. AI-generated Listing descriptions
AI-generated property descriptions must not invent features, schools, amenities, approvals, inclusions, views, renovation status, development potential, sustainability features, rental returns or price expectations.
10. AI image use
AI-generated or AI-modified imagery must not mislead users and must be disclosed where necessary to avoid a misleading impression.
11. Similar outputs
AI Features may generate similar or identical outputs for different users. You do not obtain exclusive rights in AI Outputs.
12. Monitoring and improvement
Subject to our Privacy Policy and applicable law, Addie Property may monitor and use interactions with AI Features to operate, secure, evaluate and improve the Platform.
Schedule 4 - Lead and Enquiry Rules
1. User rules
Users submitting Enquiries must:
a. provide accurate contact details;
b. submit genuine Enquiries only;
c. avoid abusive, discriminatory or threatening content;
d. not submit automated, bulk or fake Enquiries;
e. not use Enquiries to scrape, test or harvest information;
f. not impersonate another person; and
g. not use Enquiries for competitor research, spam, phishing, scams or harassment.
2. Advertiser rules
Advertisers receiving Enquiries must:
a. use Enquiry information only for the relevant property, service or transaction unless separate consent or another lawful basis applies;
b. comply with privacy, spam, tenancy, consumer and property laws;
c. not treat a single property Enquiry as consent to unrelated marketing;
d. honour unsubscribe and opt-out requests;
e. not sell, transfer, pool, enrich, scrape or misuse Enquiry data;
f. keep Enquiry data secure;
g. not use Enquiry data for unrelated marketing without consent; and
h. delete or de-identify Enquiry data when no longer reasonably required, subject to legal and legitimate business record obligations.
3. Addie Property controls
Addie Property may filter, block, delay, review, withhold or suppress Enquiries to protect users, Advertisers, privacy, security and Platform integrity.
4. Suspicious Enquiries
Addie Property may treat an Enquiry as suspicious if it appears automated, bulk-generated, abusive, fake, deceptive, malicious, competitive, spam-related, scraping-related, phishing-related or unrelated to a genuine property or service interest.
Schedule 5 - Data Protection and Anti-Scraping Rules
This Schedule applies to all users.
You must not, without Addie Property's written permission:
1. scrape or crawl the Platform;
2. use bots, spiders, harvesters, browser extensions or automated agents;
3. bulk copy, cache or store Listings;
4. extract property addresses, prices, photos, floorplans, agent details, inspection times or Listing metadata;
5. create a property database;
6. use Platform data for market research at scale;
7. use Platform data to create valuation, rent-estimation, yield, risk, lead, ranking or market-insight products;
8. train, fine-tune, test or benchmark AI models using Platform data;
9. republish or syndicate Content;
10. frame, mirror, hotlink or embed Platform pages;
11. bypass access controls, robots.txt, CAPTCHA, authentication or rate limits;
12. conceal scraping activity through proxies, rotating IPs, fake accounts or other evasion techniques;
13. combine Platform data with third-party datasets for unauthorised commercial use;
14. sell, licence or distribute Platform data; or
15. assist another person to do any of the above.
Addie Property may use technical, legal and operational measures to detect, prevent and respond to scraping and unauthorised data use.
Schedule 6 - Reviews, Ratings and Testimonials
This Schedule applies if Addie Property allows users to submit reviews, ratings, testimonials, comments, endorsements or feedback about agents, agencies, properties, developers, service providers or other users.
1. Reviews must be genuine
Reviews must be genuine, independent and based on the reviewer's own experience.
2. Prohibited review conduct
You must not:
a. submit fake reviews;
b. submit reviews for a business you own, control, work for or are connected with unless the connection is clearly disclosed;
c. procure reviews from family, friends, employees, contractors, agencies or third parties without disclosure;
d. submit competitor attack reviews;
e. submit reviews in exchange for undisclosed incentives;
f. review-gate by encouraging only positive reviewers to post;
g. manipulate star ratings, rankings or sentiment;
h. suppress genuine negative reviews;
i. edit reviews to remove negative elements or add positive elements; or
j. threaten users over genuine reviews.
3. Incentivised reviews
If incentives are offered for reviews, they must:
a. be offered equally for positive and negative reviews;
b. not be conditional on review sentiment; and
c. be clearly disclosed.
4. Moderation
Addie Property may remove, reject, label, restrict or investigate reviews that appear fake, misleading, abusive, defamatory, discriminatory, conflicted, incentivised without disclosure, irrelevant, unlawful or contrary to these Terms.
Addie Property should not selectively remove genuine negative reviews merely because they are negative.
5. Right of reply
Where practical, Addie Property may allow reviewed parties to respond to reviews, provided responses comply with these Terms.
Schedule 7 - Paid Products, Subscriptions and Fees
This Schedule applies if Addie Property offers paid accounts, premium tools, subscriptions, agent products, reports, Data Products or advertising packages through the Platform.
1. Product terms
Paid products may be governed by additional product-specific terms, order forms, plans, checkout pages, insertion orders or customer terms.
2. Price disclosure
Before purchase, Addie Property will disclose the price, billing frequency, GST treatment, mandatory transaction charges, renewal terms and key cancellation terms where applicable.
3. Subscriptions
If a product is offered as a subscription, the applicable product terms will state:
a. the subscription period;
b. renewal method;
c. billing frequency;
d. cancellation method;
e. any minimum term;
f. any notice period; and
g. any consequences of cancellation.
4. Renewal notices
Where required by law or product policy, Addie Property will provide renewal notices before automatic renewal.
5. Cancellation
Addie Property will provide a reasonably clear and accessible cancellation process for subscriptions.
If a subscription is purchased online, Addie Property should provide an online cancellation pathway unless another lawful and reasonable process is clearly disclosed.
6. No hidden mandatory charges
Addie Property will not intentionally hide mandatory transaction-based charges until late in the purchase process.
7. Refunds
Refund rights are governed by applicable law and the relevant product-specific terms.
Nothing in this Schedule limits non-excludable rights under the Australian Consumer Law.
Schedule 8 - Rental Application and Tenant Data Rules
This Schedule applies if Addie Property offers rental application, tenant screening, inspection registration, shortlisting, document upload, identity verification or related rental workflow tools.
1. Purpose limitation
Rental application and tenant data must be collected, used and disclosed only for the relevant rental, inspection, application, tenancy administration, fraud prevention, compliance, security or support purpose, unless another lawful basis applies.
2. Data minimisation
Advertisers, property managers and other recipients must not use Addie Property to collect more Personal Information from prospective tenants than is reasonably necessary for the relevant rental process.
3. Prohibited or restricted collection
Unless expressly permitted by the relevant feature and applicable law, rental workflows must not require:
a. social media account access;
b. unnecessary identity documents;
c. excessive financial records;
d. protected attributes unrelated to tenancy assessment;
e. passwords or login credentials for third-party services;
f. biometric information unless strictly necessary and lawful;
g. information about unrelated household members beyond what is reasonably necessary; or
h. information collected for unrelated marketing or profiling.
4. Retention
Advertisers and property managers receiving rental application or inspection data through Addie Property must delete or de-identify it when no longer reasonably required, subject to lawful record-keeping obligations.
5. Security
Recipients of rental application or inspection data must take reasonable steps to protect that information from misuse, interference, loss, unauthorised access, modification and disclosure.
6. No rent bidding design
Rental application tools must not be configured to require, encourage, prompt or solicit applicants to offer rent above the advertised rent where prohibited by law.
